Lei Dian, as a partner at BZW Law Firm, has been engaged in the legal profession for nearly two decades. She is a lawyer included in the Beijing Lawyers Association’s foreign-related lawyer talent pool, an A+ level patent attorney designated by the National Intellectual Property Administration (less than one hundred people nationwide meet the criteria), a member of the Beijing Intellectual Property Research Association, an intellectual property researcher at Donglv Shaohua Research Association, and an industry conduct construction volunteer selected by the National Intellectual Property Administration and the All-China Patent Attorneys Association.

Lei Dian represented Jaguar Land Rover Ltd. in a design patent confirmation dispute with Jiangling Holding Co., Ltd., which was selected by the Supreme People’s Court as one of the “Top Ten Intellectual Property Cases of 2018 in China”; the patent infringement dispute case she represented between Huizhou TCL Mobile Communications Co., Ltd. and Royal KPN Company was selected by the Supreme People’s Court as one of the “Typical Cases of Technical Intellectual Property in Chinese Courts in 2019”.

Key Projects

  • Representing the invalid declaration requester Huawei Technologies Co., Ltd., in a patent infringement case and a patent invalidity case against patent owner Samsung Electronics Co., Ltd., successfully declaring the patent rights entirely invalid, avoiding an infringement litigation risk of 80 million for Huawei;
  • Representing the defendant Huizhou TCL Mobile Communications Co., Ltd., in a Standard Essential Patent infringement case against plaintiff Royal KPN Company, successfully winning a non-infringement judgment, avoiding a 9.32 million infringement litigation risk for TCL.
  • United Kingdom: Representing the invalid declaration requester Jaguar Land Rover Ltd., in a design patent invalidity case against patent owner Jiangling Holding Co., Ltd., successfully declaring the patent rights entirely invalid, and representing subsequent administrative litigation first instance, second instance, and retrial procedures, winning the final judgment for the client; Commissioned by Jaguar Land Rover Ltd., providing a legal analysis report on the likelihood of success in filing an infringement lawsuit against Jiangling Holding Co., Ltd. based on copyright and unfair competition claims.
  • Sweden: Commissioned by Electrolux AB, conducting due diligence on a series of electronic products and technologies entering China, providing a Freedom to Operate (FTO) analysis report, analyzing intellectual property infringement risks and providing avoidance suggestions.
  • Germany: Software copyright registration for MA Lighting Technology GmbH; SIKA trademark infringement complaint.
  • United States: Representing patent owner Raychem Corporation, in a patent invalidity case against invalid declaration requester Meng Wei, successfully maintaining the validity of the patent rights.
  • Switzerland: Commissioned by a Swiss water treatment company, providing a legal assessment report on the stability, reasonableness of the protection scope, and the possibility of rights protection for intellectual property owned in mainland China, Hong Kong, Macau, and Taiwan.
  • Japan: Representing patent owner Hirose Electric Co., Ltd., in a patent invalidity administrative litigation against invalid declaration requester Kunshan Jiahua Electronics Co., Ltd., successfully revoking the invalidity decision.
  • South Korea: Representing a display panel and related equipment manufacturing company in civil and criminal litigation cases over trade secrets with former employees and affiliated companies, achieving victory.
  • France: Representing patent owner ArcelorMittal France, in a patent invalidity case against invalid declaration requester Baoshan Iron & Steel Co., Ltd., successfully maintaining the validity of the patent rights.
  • Taiwan: Commissioned by a Taiwan company, conducting long-term monitoring of intellectual property related to mobile products of competitor LG.
