From October 17 to 20, 2024, the 2024 Hainan Free Trade Port Legal Week, themed “Rule of Law in the Free Trade Port: Dialogue with the World,” was grandly opened. The event focused on legal issues related to the construction of the Hainan Free Trade Port and attracted thousands of guests from both domestic and international sectors, including renowned lawyers, legal experts, and government officials, who gathered to contribute their insights to the rule of law development in the Free Trade Port. At the forum, Geng Yajie shared the professional services that Chinese lawyers can offer to ASEAN in the field of aircraft financing and leasing. She first pointed out that, due to the impact of the pandemic, global air passenger demand has significantly decreased, and aircraft leasing companies are facing increased risks of rental deferrals, defaults, and tenant bankruptcies. In this context, the recovery and disposal of leased aircraft have become important issues. The right to reclaim the aircraft primarily involves lien rights, including operational and maintenance costs. For example, in cases involving aircraft seized in Russia, the recovery process is more challenging, and parties often pursue claims through lawsuits against insurance companies.
